Terms and Conditions: Tiki Golf Carts

1. Rental Requirements & Operator Rules

License & Insurance: Drivers must have their valid driver’s license in their possession at all times while operating the cart. The Renter confirms they possess valid auto insurance that covers the operation of a rental vehicle or RENTER ASSUMES ALL LIABILITY if insurance doesn’t cover it.

Age Requirement: All operators must be at least 21 years of age and possess a valid government-issued driver’s license.

2. Ocean Isle Beach & NC Law Compliance

Street Legality: Carts may only be operated on streets with a posted speed limit of 35 mph or less.

Traffic Laws: The golf cart is a “motor vehicle” under NC law. All traffic laws apply, including stop signs, signaling, and Driving While Impaired (DWI) laws. Open containers of alcohol are strictly prohibited on the cart.

Prohibited Areas: * NO driving on sidewalks or bike paths. NO driving on the beach or dunes. NO driving on any road with a speed limit over 35 mph (though you may cross them at a 90-degree angle where permitted). TIKI GOLF CARTS PROHIBITS RENTAL CARTS TO CROSS THE OCEAN ISLE BEACH BRIDGE        

Night Driving: Carts may only be driven at night if equipped with functional headlights and taillights. CARTS ARE EQUIPPED WITH ALL REQUIRED EQUIPMENT AND ARE LEGALLY ABLE TO OPERATE AT NIGHT 

3. Safety & Capacity

Seat Belts: All passengers must wear seat belts while the vehicle is in motion.

Seating Capacity: The number of passengers must not exceed the number of factory-installed seats/seat belts (e.g., a 4-passenger cart carries a maximum of 4 people).

Children: NC Child Restraint Laws apply. Children requiring a car seat or booster seat in a car must use one on the golf cart. Child restraint equipment is not provided by Tiki Golf Carts.

4. Equipment Maintenance & Battery Care

Charging: Renters are responsible for charging the electric cart daily. The charger must be kept dry and away from standing water.

Return Condition: Carts must be returned in a clean condition and fully charged. A “Low Battery” fee of $75 or a “Cleaning Fee” of $50 may apply if returned otherwise.

Damage/Theft: The Renter is 100% responsible for any damage, theft, or loss of the cart, keys, or charger during the rental period.

5. Liability Waiver & Indemnification

Assumption of Risk: The Renter acknowledges that operating a golf cart involves inherent risks of injury or death.

Release of Liability: The Renter hereby releases Tiki Golf Carts (Tikigolfcarts.com) and its owners from any and all claims for personal injury, property damage, or wrongful death arising from the use of the rental.

Indemnification: Renter agrees to indemnify and hold harmless Tiki Golf Carts against all citations, fines (including parking tickets), or legal fees incurred during the rental period.

6. Cancellation & Refunds

Cancellations made 14 days prior to arrival will receive a full refund.

No refunds will be issued for early returns, inclement weather (unless a mandatory evacuation is ordered), or mechanical issues resulting from Renter misuse.

Credit Card Authorization: A clause allowing you to charge the card on file for damages, lost keys ($25+), or uncharged batteries.

NOTE: Tiki Golf Carts supplies parking permits for Ocean Isle Beach and renters should be familiar with parking ordinances which can be found on the Ocean Isle Beach official website here. Any summons received for violation of the ordinance will be the sole responsibility of the renter. An administrative fee of $25 will be charged if action to collect fines is required.
